Why did microstudio put my "Super Mario Bros in Microstudios" away from the explore section?

I am so sad Like very sad. And since they put my project away, why are not the other mario games put away? Please whoever did this fix it PLEASE. :(

I left a comment explaining why, but for the record, the issue lies with the copyright.

First off, it is against the ToS of Microstudio itself. You are not allowed to post copyright infringing content, which includes names and sprites from companies that have claimed copyright for it.

The entire Mario franchise is copyrighted by Nintendo, and so are the sprites. They are intellectual properties of Nintendo.

This is the actual problem.

If you wish for your project to return to the explore section, you have to remove / change the copyright infringing parts, which is the name, and the following sprites.

The sprites in question are: 1coin, 1up, both checkpoints, goal, goomba, goomba_squished, ground, icon, mario, mario_dies, mario_jump, mario_poster, mario_run, sky, super_mushroom.

That also means you have to change the names as well as the sprites themselves.

So your telling me to just change all of the sprites and names. That is basically making another game. 😞 I am depressed.

It is still copyright infringement if you don't make money from it. This is the U.S. Copyright Office’s definition for copyright infringement:

"Copyright infringement occurs when a copyrighted work is reproduced, distributed, performed, publicly displayed, or made into a derivative work without the permission of the copyright owner."

While it doesn't mention money in any manner, the game essentially was reproduced, publicly displayed, and made into a derivative work (a fan game in this case). Here, there is no copyright infringement, as it's not directly infringing anymore.

Another example: You include a significant portion of a song lyric in something you wrote. Let’s say you post it to a website for free access by anyone, you ask for no money, and claim full authorship. The owner of the copyright to that song lyric has every right to send you a cease-and-desist letter, basically saying take this derivative work down, or we will lawyer at you. They certainly can’t sue you for their fair share of no money, but they can contact the website you posted this to and have THEM take it down.

In that case, that is US, and since the ToS explicitly forbid this kind, it's, again, not allowed in the original shape or form.
